Terms and Conditions
The person in receipt of tuition or proofreading made through Larkin Tutors will hereafter be referred to as ‘the Client’.
If you wish to unsubscribe from Larkin Tutors’ emails, please contact us via our contact form.
By confirming a tuition placement or proofreading service as a Client, you explicitly agree to Larkin Tutors Terms of Service. Larkin Tutors Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom.
Acceptance of and payment for our services is an explicit agreement to these Terms and Conditions.
Larkin Tutors will not condone or tolerate unethical academic practices including, but not limited to plagiarism and intellectual property violation. Any request for such practices to be carried out can result in the immediate cancellation of a tutorial or proofreading service. Full responsibility for the content of any academic work submitted to any institution rests with the Client, and Larkin Tutors will not accept liability for the consequences of plagiarism.
Larkin Tutors reserves the right to determine what constitutes a request for unethical practice, and to refuse their services to anyone making such a request. Anyone deemed to have made such a request, whether enacted or otherwise, will cease to be a client of Larkin Tutors, and will forfeit their right to any assistance or protection under these Terms.
Larkin Tutors reserves the right to reasonably alter these terms and conditions. Unless otherwise agreed in writing by an owner of Larkin Tutors, and with the exception of specific employment contracts, these terms and conditions shall prevail over any other terms of business or conditions put forward by the Client or the Tutor.
Responsibility for the content of lessons, and the teaching methods employed, remain with Larkin Tutors. We offer the following as common practises in the industry, that should be expected unless otherwise specified by the Tutor.
Both the Client and the Tutor should notify the other in advance of any holiday commitments they may have, and any changes to the tuition timetable necessary because of illness or inconvenience. Tutorials must be cancelled a minimum of 24 hours prior to the arranged tutorial start time, otherwise the cancellation will be considered late. The Tutor may agree an alternative date or time for the session, but may at their discretion continue to treat this as a late cancellation. Where late cancellation is made the Client is liable for 50% of the full cost of the planned tutorial. If the Client cancels more than 24 hours prior to the arranged tutorial start time, no payment is liable. If late cancellation is made by the Tutor (within 24 hours of the tutorial) the Client is not liable, and may request a replacement Tutor.
Late Arrival Policy
Where cancellation by either party is made with less than two hours’ notice, or if either fails to arrive at the arranged place and time for a tutorial, this will be considered non-attendance. Where the Client is at fault, they will be liable for the full cost of the planned tutorial, or any period during which they were not present. If the Tutor is at fault, Larkin Tutors will provide the Client with a full refund. Either party may, with the agreement of the other, continue the session beyond the planned time-limit, but this will not automatically waive any liability for late arrival, which remains at the discretion of the disadvantaged party.
Where the Client is dissatisfied with the first tutorial, Larkin Tutors will not request payment from them, and will refund any payment made by them for the tutorial in advance, subject to the following conditions:
In order to be eligible for this refund, the Client should have terminated the tutorial before the scheduled finish time, and contacted a different staff member at Larkin Tutors immediately. If the Client has not contacted Larkin Tutors within 24 business hours of the first tutorial, no waiver or refund can be guaranteed.
The grounds for invocation of the guarantee must also be reasonable, as determined by Larkin Tutors; for example, self-evidently sub-standard tuition constitutes reasonable grounds, but disagreement with commonly practised teaching methods may not.
Where these conditions are not met, Larkin Tutors cannot guarantee any waiver or refund and accept no liability for any consequences that arise from the tuition.
Satisfaction Guarantee and Refunds Policy
A. First Advice of Dissatisfaction
Larkin Tutors is committed to the provision of high-quality editing or proofreading services, based on the order details, to the Client. If the Client, for any reason, is not satisfied with the work completed by Larkin Tutors, the Client agrees to contact Larkin Tutors by email at email@example.com within ten (10) business days of receiving the work, with the Client’s detailed written explanation of dissatisfaction, before seeking reimbursement.
B. The Amendment Period
Once the Client has provided Larkin Tutors the Advice of Dissatisfaction, the Client agrees to provide Larkin Tutors with a reasonable Amendment Period, no more than 24 hours per 5000 words, in order for Larkin Tutors to make the necessary changes and resubmit to the Client a Second Edit.
C. The Responsibility of the Client
The Client agrees to provide Larkin Tutors with any and all additional information in order to allow Larkin Tutors to make any necessary amendments to the document in order to meet with, and satisfy the expectations of the Client’s based on the service ordered or information initially supplied by the Client at the point of ordering. To allow Larkin Tutors to complete the service to meet the expectations of the Client, it is the responsibility of the Client to provide clear and sufficient instructions to Larkin Tutors. Should the Client not provide Larkin Tutors with clear and sufficient instructions, the Client agrees to be bound by Larkin Tutors’ description of services, or Larkin Tutors reasonable interpretation of any instructions supplied by the Client.
D. Second Advice of Dissatisfaction and Request for a Refund
Once the amended document has been received, if the Client is still not satisfied, the Client agrees to email Larkin Tutors within three (3) business days of this date with a second Advice of Dissatisfaction. The Client agrees to explain in detail the reasons for this dissatisfaction and to then request a refund.
E. Refund Conditions
1. Following the Second Advice of Dissatisfaction
If Larkin Tutors cannot reasonably address the reason, or reasons, for the dissatisfaction of the Client, and provided the Client has made reasonable efforts to provide assistance and information to Larkin Tutors in order to allow it to carry out alterations during the Amendment Period, Larkin Tutors will provide the Client with a refund, proportional to the percentage of errors remaining in the document in relation to the number of corrections made.
No refund will be made if, within ten (10) business days of receiving the completed work, the Client does contact Larkin Tutors by email with their Advice of Dissatisfaction.
No refund will be made if the Client does not provide Larkin Tutors the opportunity to address any dissatisfaction by providing The Amendment Period, together with detailed reasons of the initial dissatisfaction. Also, no refund will be made if after receiving the Second Edit, the Client does not inform Larkin Tutors within three (3) business days of any continued dissatisfaction, explaining the Client’s the reasons for their continued dissatisfaction and to request a refund.
F. Satisfaction Guarantee
For purposes of this Agreement, the expression “Satisfaction Guaranteed” implies a guarantee that is limited to ensuring the Client receives a high standard of proofreading and editing services from Larkin Tutors. It does not guarantee any marks or grades, or any other material gain as a result of the service carried out by Larkin Tutors. The Client is solely responsible for the content of the document and thus any intended meaning. In the event where the intended meaning has been misunderstood by Larkin Tutors, it is the Client’s responsibility to bring this to the attention of Larkin Tutors so that alterations can be made. The expression “satisfaction,” is determined by what a reasonable individual would consider as an objectively satisfactory and reasonable service.
Larkin Tutors does not accept any liability for the consequences of tuition and proofreading, including, but not limited to, exam results and dissertation scores.
Fees and Payment
In most instances, payment should be made up-front and in full using PayPal before commencement of services.
In exceptional cases, where an alternative method of payment has been agreed in advance by both parties, all goods remain the property of Larkin Tutors until paid for in full.
Monies that remain outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, the Client shall be liable for any and all additional administrative and/or court costs. All bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.
In the case of group tutorials, a discounted rate per person will be offered. If one or more of the Clients do not attend the tutorial, the tutorial will be charged at the standard hourly rate.
The Tutor may wish to charge additional expenses such as text books and travel expenses to the Client, but these must be agreed upon before each tutorial with the Client.
Termination of Agreements
Both the Client and Larkin Tutors have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.
